1. Acceptance
By accessing this website, signing into our products, or executing a Sohi Technology order form, you agree to these Terms. If you don't agree, please don't use our products.
2. The service
Sohi Technology Pvt Ltd (“we”) provides enterprise software-as-a-service products including CheckTime (biometric attendance), GymStudio (gym management), ActHour (productivity monitoring), and associated hardware. The specific products you've licensed are described in your order form.
3. Accounts
Customer organisations create user accounts for their employees and are responsible for keeping credentials secure. We aren't liable for losses arising from a customer's failure to protect login details. Sharing credentials between people is prohibited.
4. Acceptable use
- Don't reverse-engineer, decompile, or attempt to discover source code.
- Don't use the service to violate laws (including data-protection laws), infringe IP, or send spam.
- Don't probe, scan or test the vulnerability of any system without prior written permission. (For coordinated disclosure, email admin@sohitechnology.com.)
- Don't use the productivity-monitoring features (ActHour) on individuals without their knowledge where the law requires consent. Customers are solely responsible for compliance with local labour laws.
5. Fees
Subscription fees are billed per the order form. Annual subscriptions are non-refundable; monthly subscriptions can be cancelled with 30 days' notice. Hardware purchases are non-refundable once shipped, except for manufacturing defects covered under warranty.
6. Customer data
You retain ownership of your data. We process it on your instructions per our Privacy Policy. We don't sell it or use it to train external models without explicit permission.
7. SLA and availability
Cloud-hosted plans target 99.9% monthly uptime. Service-credit terms are in your order form. Planned maintenance is communicated 48 hours in advance where possible.
8. Warranties & disclaimers
The service is provided “as is”. Except as expressly stated in an order form, we disclaim all implied warranties to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the fees you paid us in the 12 months preceding the claim. We aren't liable for indirect, incidental, or consequential damages.
10. Indemnity
You indemnify us against claims arising from your use of the service in violation of these Terms or applicable law, including misuse of personal data of your employees or members.
11. Termination
Either party may terminate for material breach not cured within 30 days of written notice. On termination, we'll make a customer's data available for export for 60 days, then delete it.
12. Governing law
These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Mohali, Punjab — except where local mandatory consumer-protection law dictates otherwise.
13. Changes
We may update these Terms with at least 30 days' notice. Continued use after the effective date constitutes acceptance.
